The Commissioner may review a decision of the Registrar of Motor Vehicle Services to grant or deny access to personal driving and motor vehicle information under the Access to Motor Vehicle Information Regulation (AMVIR).
A request for review must be made to the Commissioner within 60 days of publication of the Registrar’s decision on the Registrar’s website. The right to request a review extends to:
- An individual who believes that his or her own personal driving and motor vehicle information may be released as a result of the Registrar’s decision
- The person who made the request to the Registrar for access to personal driving and motor vehicle information
The Commissioner’s power to review a decision of the Registrar is set out in Division 1.1 of the Freedom of Information and Protection of Privacy Act (FOIP). AMVIR is a regulation under section 8 of the Traffic Safety Act of Alberta.
