The Office of the Information and Privacy Commissioner of Alberta (OIPC AB) issued an order to Clearview AI.
The order requires Clearview to:
- Cease offering all of the facial recognition services that have been the subject of this investigation to clients in Alberta
- Cease the collection, use and disclosure of images and biometric facial arrays collected from individuals in Alberta
- Delete images and biometric facial arrays that have been collected from individuals in Alberta and that are in its possession
Clearview has 50 days to report to the Commissioner on the good faith steps that it has taken to comply with this order. The order may be subject to judicial review.
The order was issued under the Personal Information Protection Act, Alberta’s private sector privacy law.
The order follows Clearview’s refusal to implement recommendations made in a February 2021 investigation report issued by the Office of the Privacy Commissioner of Canada, Commission d’accès à l’information du Québec, Office of the Information and Privacy Commissioner for British Columbia and OIPC AB.
The OIPC will not comment on the order. The order speaks for itself.
